These Terms & Conditions govern the use of websites, software, Project Previews, visualisation tools, interactive sales pages, communication systems, automation services and related products and services provided by Burgess Technologies Ltd trading as Burgess Previews.

By accessing or using our services, you agree to be bound by these Terms & Conditions.

If you do not agree with these terms, you should not use our services.

Burgess Previews provides customer acquisition, visualisation, engagement and follow-up systems designed to help businesses showcase their services, generate enquiries and convert opportunities into work.

Services may include:

• Interactive sales pages
• Options Visualisers
• Lead and enquiry capture
• Automated SMS and email follow-up
• Enquiry nurture
• Smart upsells
• Post-project upsells
• Competitions and referral systems
• Cinematic videos and project content
• Local Project Map features
• Website and CRM integrations
• Hosting and related software services

Available features may vary depending on the selected package, sector, subscription or individual agreement.

Some features may be introduced, changed or made available at a later date.

Burgess Previews may use artificial intelligence and other image-processing technologies to create visual representations of potential projects.

Project Previews are illustrative concepts only.

They are designed to help customers visualise ideas and potential transformations and should not be considered an exact representation of the final completed project.

A Project Preview is not:

• An architectural drawing
• A technical drawing
• A construction specification
• A planning document
• A survey
• A quotation
• A guarantee of materials, colours, dimensions or finishes
• A guarantee of the final appearance of completed work

Artificial intelligence may generate or alter details that differ from what is technically possible or ultimately supplied.

Final designs, specifications, measurements, materials, colours, pricing and suitability should always be confirmed directly with the business carrying out the work.

Businesses using Burgess Previews remain responsible for their own:

• Products and services
• Quotations
• Pricing
• Customer agreements
• Project specifications
• Measurements
• Materials
• Installation or construction work
• Warranties and guarantees
• Regulatory and legal obligations

Burgess Previews provides technology and customer engagement tools.

Unless expressly agreed otherwise, Burgess Technologies Ltd is not the contractor, installer or supplier carrying out the underlying project shown in a Project Preview.

Any contract for the actual project is between the customer and the relevant business providing that work.

You agree to:

• Provide accurate information when using our services
• Use our services only for lawful purposes
• Comply with applicable laws and regulations
• Not attempt to gain unauthorised access to our systems
• Not interfere with or deliberately disrupt our services
• Not upload unlawful, offensive, misleading or inappropriate content
• Maintain the confidentiality of any account credentials provided to you
• Ensure that you have the appropriate rights or permission to upload content

You are responsible for activity conducted through your account where applicable.

Users may submit content including:

• Property photographs
• Project photographs
• Vehicle photographs
• Before and after images
• Competition entries
• Reviews
• Messages
• Enquiry information
• Other photographs, images or media

You retain ownership of content that you own.

By submitting content, you grant Burgess Technologies Ltd permission to store, process, transmit and modify that content where reasonably necessary to provide the requested Burgess Previews service.

For example, an uploaded property photograph may need to be processed by artificial intelligence or third-party image-processing technology to create a Project Preview.

By uploading content, you confirm that you have the necessary right or permission to provide and process it for the intended purpose.

We reserve the right to refuse or remove content that is unlawful, offensive, inappropriate or which we reasonably believe infringes the rights of another person.

Certain Burgess Previews features may use third-party artificial intelligence technology.

AI-generated content can occasionally contain inaccuracies, inconsistencies, unexpected alterations or unrealistic details.

We do not guarantee that AI-generated content will:

• Be completely accurate
• Represent technical feasibility
• Reproduce exact colours or materials
• Preserve every detail of an original photograph
• Match the eventual completed project

AI-generated content should therefore be treated as a visual concept rather than a technical or contractual specification.

Burgess Previews may provide automated SMS, email and other communication features.

Businesses using these features are responsible for ensuring that their communications comply with applicable laws and regulations, including requirements relating to privacy and electronic marketing.

Automated communications may include:

• Enquiry acknowledgements
• Project Preview delivery
• Enquiry follow-up
• Appointment or project communications
• Enquiry nurture
• Relevant upsell opportunities
• Post-project communications

Users should ensure that contact information provided is accurate.

Where competitions, prize draws, referral campaigns or promotions are provided through Burgess Previews:

• Additional campaign-specific terms may apply
• Eligibility requirements may apply
• Fraudulent or duplicate entries may be removed
• Promotions may be amended, suspended or withdrawn where reasonably necessary

Where a competition or promotion is operated by one of our business customers, that business may be responsible for the promotion and any associated prizes.

Certain Burgess Previews services are provided on a monthly, annual or other recurring subscription basis.

Unless otherwise agreed in writing:

• Subscription fees are payable in advance
• Services remain available while required payments are maintained
• Failure to pay may result in suspension or termination
• Features included within a subscription may depend on the selected package
• Usage allowances may apply to certain services

Fees already paid are non-refundable except where required by law or expressly agreed otherwise.

Any specific minimum term, cancellation period or notice requirement agreed when purchasing the service will also apply.

Certain services may rely on third-party providers for functions such as:

• SMS
• Email
• Artificial intelligence
• Image generation
• Video generation
• Cloud storage
• Hosting
• CRM services
• Automation

Where usage limits or additional charges apply, these may be specified separately as part of the relevant Burgess Previews package or customer agreement.

We aim to provide reliable services but cannot guarantee uninterrupted or error-free availability.

Services may occasionally be unavailable because of:

• Maintenance
• Software updates
• Infrastructure upgrades
• Third-party outages
• Internet or telecommunications failures
• AI provider availability
• Technical problems
• Circumstances beyond our reasonable control

We will make reasonable efforts to minimise disruption where practical.

Unless otherwise agreed in writing, the Burgess Previews platform, software, systems, designs, branding, workflows and associated technology remain the intellectual property of Burgess Technologies Ltd or its licensors.

You may not, without permission:

• Copy our software
• Resell or sublicense our platform
• Reverse engineer our systems
• Reproduce proprietary functionality
• Redistribute our software or technology
• Remove Burgess Technologies Ltd's proprietary rights where applicable

Businesses retain ownership of their own logos, photographs and other content supplied to us.

Where Burgess Previews generates Project Previews, cinematic videos or other content for a subscribing business, that business may use the resulting content for its normal business and promotional activities, subject to any applicable third-party technology or licensing restrictions.

This does not transfer ownership of the underlying Burgess Previews software, systems, templates, workflows or technology.

Burgess Previews may integrate with or depend upon third-party services including:

• Artificial intelligence providers
• SMS providers
• Email providers
• CRM platforms
• Automation providers
• Hosting and cloud providers
• Analytics services
• Social media platforms
• Website providers

Third-party services operate under their own terms and policies.

We cannot guarantee the continuous availability or performance of services operated by third parties.

Personal information is handled in accordance with our Privacy Policy and applicable data protection law.

Businesses using Burgess Previews are also responsible for ensuring that their own collection and use of customer information complies with applicable data protection and privacy requirements.

To the fullest extent permitted by law, Burgess Technologies Ltd shall not be liable for indirect or consequential losses arising from use of Burgess Previews, including:

• Loss of profits
• Loss of business opportunities
• Loss of anticipated savings
• Service interruptions
• Third-party failures
• Reliance upon an AI-generated visualisation as an exact project specification

Our total aggregate liability in connection with the relevant paid service shall not exceed the amount paid to us for that service during the preceding 12 months.

Nothing in these Terms excludes or limits liability where doing so would be unlawful, including liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation.

Burgess Previews is designed to help businesses showcase their work, generate opportunities and improve customer engagement.

However, we do not guarantee:

• A particular number of enquiries
• A particular conversion rate
• Increased revenue
• Specific sales results
• That an enquiry will become a paying customer
• That use of Project Previews will result in a completed project

Business results depend on many factors outside our control.

We may suspend or terminate access to Burgess Previews where:

• These Terms are materially breached
• Illegal or fraudulent activity is suspected
• Our systems are deliberately abused
• Content is used unlawfully
• Payments remain outstanding
• Continued use creates a security or operational risk

Termination does not remove obligations or liabilities arising before termination.

Burgess Previews will continue to develop over time.

We may improve, modify, replace, add or discontinue features where reasonably necessary.

Where practical, significant changes materially affecting a paid service will be communicated to customers.

Features marked Coming Soon are planned features and should not be treated as a guarantee that a feature will be released on a particular date or in a particular form.

We may update these Terms & Conditions from time to time to reflect changes to our services, technology, business practices or legal requirements.

The latest version will be published on our website together with the date it was last updated.

These Terms & Conditions are governed by the laws of England and Wales.

Any dispute shall be subject to the jurisdiction of the courts of England and Wales, subject to any mandatory rights that apply under applicable law.
